This talk deals with the developing area of the law regarding the requirement for claimants in deceit and misrepresentation to prove that they were aware of and understood the alleged representation. This is of particular relevance to the increasingly common claims which are founded on implied misrepresentations, and it is an issue which has arisen frequently in the defences to recent group action claims such as the Volkswagen litigation. This talk will address how the requirement of knowledge and awareness developed, how strict the present requirements are, and how claimants can seek to overcome the challenges.
Each lecture will begin at 6 p.m., will last approximately one hour, which will include an opportunity for questions. The lectures will be followed by an opportunity for drinks and networking. Materials and, if practicable, a video recording will appear on the LSLA website after the event.
